This regulation defines the rules for using the online store at www.usaczesci.rzeszow.pl, in particular the mutual rights and obligations of the seller and customers who are solely consumers within the meaning of Article 22[1] of the Civil Code of 23 April 1964 (Journal of Laws of 18 May 1964, No. 16, item 93, as amended, hereinafter: the Civil Code).
I. GENERAL PROVISIONS
1. The regulation defines the rules under which a User, who can become a Buyer, uses the Store. The regulation is universal and continuously available on the Seller's Store website.
2. The prices of goods in the Brodmir company online store are given in Polish zlotys and include VAT (gross prices).
3. Goods are shipped within the TERRITORY OF POLAND. I agree to ship goods abroad after prior agreement on shipping costs.
4. Persons using the store are obliged to refrain from intentional actions leading to harm to the online store.
5. Information contained in the Online Store is not an offer within the meaning of the Civil Code, but only a proposal to conclude a contract, as provided for in Article 71 of the Civil Code.
6. Anyone who has full legal capacity may use the store.
7. Using the store means that the User accepts the store's regulations, the address of which is on the homepage.
8. The User who decides to use the Store and place orders must provide true, current, and complete data enabling his or her identification.
9. The User may not share his or her login information with third parties.
10. The User may not use the data contained in the Store for his or her own purposes, including photos, descriptions, or any graphics, unless the Seller has ruled otherwise.
II. TYPE OF SERVICES PROVIDED
The Seller, as part of the online store, carries out distance sales of goods via the Internet. The seller posts information about goods and services (the main characteristics of the service, taking into account the subject of the service) on the website www.usaczesci.rzeszow.pl, but informs about prior telephone contact to confirm the compatibility of the part that the customer wants to purchase.
III. SELLER'S DATA
The sale is conducted by BRODMIR SP. Z O.O. registered in the National Court Register under the name BRODMIR SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office at Hermanowa 567, 36-020 Tyczyn, NIP: 813-388-64-84, REGON: 523338085, KRS: 0000995781.
All correspondence can be addressed to: Hermanowa 646C, 36-020 Tyczyn. Contact with the seller is also possible via email: brodmir@usaczesci.rzeszow.pl and telephone number: 602-494-759. The cost of calling the indicated phone number is determined according to the tariff package of the service provider used by the customer.
IV. ORDER PLACEMENT AND FULFILLMENT PROCEDURE
1. A user who wants to place an order through the website must review and accept the terms and conditions of Brodmir Sp. z o.o.
2. The email address and phone number provided by the user may be used to fulfill the orders placed.
3. Proper completion of the order form provided by BRODMIR on the online store website is a basic condition for the fulfillment of purchases made.
4. In case of circumstances that make it completely or temporarily impossible to fulfill the placed order, BRODMIR reserves the right to suspend order fulfillment, and will promptly inform the ordering party of the situation.
5. In the event of an out-of-stock item, the store informs the buyer and specifies the delivery date or proposes a product with comparable features, if possible. The buyer may cancel the purchase, wait for the delivery, or accept the proposed product. The client must inform the store of their decision via email. Failure to decide is equivalent to canceling the purchase.
6. Incorrectly filled out order forms will not be processed.
7. Purchased goods are delivered to the address specified in the order form.
8. The customer has the right to choose the delivery method according to the order form.
9. The shipping costs are covered by the buyer. In certain cases, if allowed by BRODMIR, the fee for delivering the ordered goods may be covered by BRODMIR.
10. The user is obliged to provide current and truthful information when placing an order.
11. Brodmir Sp. z o.o. operating the online store reserves the right to temporarily suspend store operations without specifying a specific reason, and will inform users about this fact on the main page in advance.
12. Brodmir Sp. z o.o. is responsible for sending purchased products through the website. However, in the event of an error caused by the user, BRODMIR is not obliged to accept a product return.
13. In the case of incorrect goods due to the user's fault, the user bears the transport costs, unless both parties agree otherwise.
14. It is possible to place an order by email or phone. However, in the case of email orders, it is necessary to inform Brodmir Sp. z o.o. about the order by phone.
15. The customer has no right to return purchased goods if the product was ordered by the seller for the individual order of the user.
16. Orders for products that we have in stock are fulfilled within 3 working days. Individual orders from the USA will be fulfilled after a deposit is paid, and the delivery time will be determined by email or phone.
V. WARRANTIES AND COMPLAINTS
1. Goods offered in the online store of COMPANY BRODMIR are covered by the manufacturer's or importer's warranty (excluding consumable parts such as brake system friction elements).
2. BRODMIR is not responsible for delayed delivery and damages caused during delivery by the courier company "DPD" or "INPOST".
3. Customer complaints are resolved within 14 days from the receipt of the complained goods.
4. Complaints are accepted up to 14 days from the date of complaint notification via a form along with a RECEIPT or VAT INVOICE.
5. The warranty period for Entrepreneurs is 12 months, whereas for retail customers, it is 24 months from the date of purchase.
6. Complaints do not apply to goods that are incorrectly installed or installed in vehicles with modifications that increase component wear (e.g. a hub for a vehicle with spacers installed).
7. Complaints are considered only after filling in the complaint protocol correctly. A complete description with error codes and faults is required. In individual cases, further correspondence will be conducted via email.
VI. PRICES / COSTS / PAYMENT
1. The user is obliged to pay the full amount for purchased goods, including the shipping fee established by the seller.
2. The seller is obliged to issue a document confirming the purchase of the goods to the user.
3. The user has the option to choose the payment and delivery methods offered by the seller.
4. The customer does not incur any shipping costs if they pick up the goods at the company's headquarters at Seniora 2c, 35-11 Rzeszów.
5. In the case of payment by bank transfer, the shipment of the goods takes place when the seller receives the money into their account or when the user provides electronic confirmation of the transfer.
6. All prices listed in the online store are gross prices.
VII. RETURNS
1. The user has the option to return the received goods within 14 days of receiving them.
2. The user can inform about the withdrawal from the agreement through the complaint form, filling in all fields of the form, by phone at 602-494-759, or in person at the company's headquarters: 35-311 Rzeszów, ul. Seniora 2c.
3. The user sends the goods to the company's address: 36-020 Tyczyn, Hermanowa 646C.
4. In accordance with Art. 35 of the Consumer Rights Act, in the event of resignation and withdrawal from a distance agreement by the customer for parts that we do not physically have in stock, which are under order, within 14 business days, Brodmir has the right to charge the costs incurred as a result of importing and returning the goods to the USA in accordance with the international price list of DHL Express. Any delays caused not by Brodmir (e.g., delays caused by customs agencies or logistics companies) do not exclude the charging of the aforementioned costs.
5. Only unassembled goods with the original box are eligible for returns.
VIII. PURCHASES THROUGH PAYU AND PRZELEWY24
1. The user has the option to pay for the goods through the PayU and Przelewy24 services after familiarizing themselves with the PayU and Przelewy24 regulations, which are available on the service provider's website.
2. Shipping is carried out through the services of the DPD transport company. Shipping is carried out within 24 hours of receiving the order. Shipping costs: cash on delivery - 25 PLN, shipping after prepaying the order - 21 PLN.
3. The user has the option to return the ordered goods within 14 days of receiving them.
4. The provisions of the Personal Data Protection Act of August 29, 1997, regarding the protection of personal data, apply.
IX. PURCHASES THROUGH POLISH E-PAYMENTS
1. Payments are processed by "Polskie ePłatności" limited liability company with its registered office in Tajęcina (formerly "Paylane" sp. z o.o.), address: Tajęcina 113, 36-002 Jasionka, KRS: 0000227278, NIP 5862141089 and REGON 220010531.
